Choose a source by the event you need to prove. A recent complaint may appear in Magistrate Case Record Search before a felony reaches Circuit Court. A jail result can show present custody yet say nothing final about guilt. Certified outcomes come from the clerk, not from a booking screen.

Before searching, gather a full legal name, likely spelling variants, date of birth if lawfully available, an incident or case number, and a useful date range. Common names can fill the Magistrate system's 30-result limit. A case number is the best match key when it is known.

1. Search Magistrate Case Record Search for a new complaint, bond action, misdemeanor, or felony preliminary matter.
2. Use WVPASS for eligible public Circuit Court cases and documents filed from July 1, 1999, forward.
3. Check WVDCR Daily Incarcerations or Jail Search when the question concerns current regional custody.
4. Call the arresting agency for its incident or arrest report, since a court clerk does not keep the full police file.
5. Ask the correct clerk for a certified disposition, or use WVSP and IdentoGO for an authorized fingerprint-based check.

Two Ohio County Court Record Portals

WVPASS and Magistrate Case Record Search cover different parts of an Ohio County criminal case. WVPASS requires a free account, email verification, and two-factor sign-in. Public Circuit Court documents cost $0.25 per page plus the card processing charge shown at checkout, remain in Purchase History for 30 days, and are printable but not certified. The portal allows party-name or case-number searches and logs an idle user out after 60 minutes.

Magistrate Case Record Search has no account fee and no document images. It accepts first name, last name, or case number after a CAPTCHA and terms gate. Results stop at 30. Use it for misdemeanor dockets, initial felony complaints, bond entries, and preliminary events, then contact Magistrate Clerk Gerald O. Ames Jr. at 304-234-3709 for a file or certified copy. A clerk-run written criminal-history search costs $25 per name, while use of a courthouse public terminal is exempt from that fee.

West Virginia Official Background Checks

The West Virginia State Police Criminal Identification Bureau holds the state criminal-history repository. It is biometric, which means fingerprints link an identity to reported arrest cycles and dispositions. WVSP does not offer an open public name-only portal. Under W. Va. Code §15-2-24(d), release to a private person or organization requires the record subject's signed and acknowledged authorization.

WVSP sends fingerprint capture to IdentoGO by IDEMIA. The person begins with the service code supplied by the authorized program, chooses “Schedule or Manage Appointment,” enters identity and appointment details, retains the confirmation number, and brings the required identification. Fees and the destination of results vary by service code. Local police and WVSP headquarters no longer perform this background-check capture service.

This official channel verifies identity in a way that a public Ohio County court name search cannot.

Ohio County Fingerprint Record Routes

Fingerprint checks serve distinct purposes. For a state record correction, WVSP Form 136A asks for the current entry and the proposed correction, the basis for the change, identification details, a right-index fingerprint, signature, and date. The $20 fee is paid by cashier's check or money order to the Superintendent, West Virginia State Police. If a court disposition is wrong or missing, address it first with the court or arresting agency that submitted the data. The challenge process fixes inaccurate data. It does not erase an accurate record.

A person seeking a federal self-review can use the FBI electronic request process for their own Identity History Summary. The FBI fee is $18, apart from fingerprint or channeler cost. It reports material sent to the FBI and may omit a local event that was never submitted.

Criminal Record Types

Ohio County criminal records are made at different points in the justice process. An agency report reflects what officers recorded. A booking record reflects intake and custody. A docket reflects what was filed and what the court did. A CIB history ties submitted events to fingerprints. None can stand in for all the rest.

• Incident and arrest report: held by the sheriff, Wheeling Police, WVSP, a town department, or campus police that made the report.
• Booking and custody entry: created in the WVDCR regional system and updated as custody changes.
• Magistrate or Circuit file: records complaints, bond, charges, motions, pleas, outcomes, and sentences at the proper court level.
• Warrant record: issued by a court and handled by law enforcement; selected Most Wanted notices are not a full warrant search.
• Supervision or registry record: probation, parole, and sex-offender data remain in their own legal and agency systems.

Police reports, warrant status, probation, parole, and juvenile matters all have separate access limits. West Virginia also defines felony punishment by each offense statute rather than a simple Class A, B, or C chart. General felony and misdemeanor penalty provisions apply only when the offense does not set another punishment.

Ohio County Arrest Records Cross County Lines

An arrest in Ohio County may produce a custody result in Moundsville. Northern Regional Jail and Correctional Facility opened in 1994 and serves Ohio County with five other counties. It stands in Marshall County, has a design capacity of 608 jail detainees, and holds jail detainees and state inmates under one roof without commingling them. This regional model is why a sheriff-branded local roster is not the main custody tool.

The former county jail at 1501 Eoff Street was built in 1974, stopped serving as the county jail when Northern Regional opened, and entered state lease use in 1998. The fields depend on the record's purpose. A CIB record centers on fingerprint identity and reported arrest cycles. An Ohio County court file centers on one case. A booking entry centers on present custody. Public portals also omit sealed, juvenile, or security-restricted material, so fewer visible fields do not always mean fewer underlying records.

Downtown Wheeling concentrates several record offices but does not merge their files. The City-County Building at 1500 Chapline Street houses the Ohio County Circuit Clerk, Circuit Court, and Prosecuting Attorney. Public Access Laws in West Virginia

The West Virginia Freedom of Information Act supports access to reasonably described existing public records from the office that holds them. It does not force an agency to create a new answer or compile facts that do not already exist. Court access follows its own statute and court rules. Fingerprint repository data has stricter consent controls, while sealed, juvenile, victim-sensitive, and protected investigative material may be withheld or redacted.

Ask for segregable public parts and the cited exemption when only part of an Ohio County criminal record is withheld.

WVFOIA Fills Ohio County Record Gaps

Use WVFOIA when an existing agency record is not supplied through a portal. Direct the request to the agency that made the record. Ohio County Sheriff Records cannot produce a Wheeling Police report merely because both agencies work in the county. Likewise, a clerk has the filed complaint and court orders, not the investigating officer's full narrative or evidence inventory.

Describe the incident number if known, the date range, location, involved people or units, and the exact item sought. Ask for electronic delivery and a cost estimate before reproduction. The county has not published a universal sheriff report form, fixed criminal-report fee, or guaranteed turnaround. Calling 304-234-3792 first can prevent a request from going to the wrong custodian.

Sealed, Expunged, and Restricted Records

West Virginia offers several expungement routes, but eligibility and timing depend on the outcome and offense. Under §61-11-25, a person acquitted or whose state charge was dismissed in qualifying conditions may petition the Circuit Court where charged after at least 60 days. Successful pretrial diversion or deferred adjudication can also qualify. The Judiciary's SCA-C903 form calls for the county, case number, arrest agency, offenses, dates, court level, eligibility claims, signature, and proof of service.

For eligible convictions under §61-11-26, the wait is measured from the latest of conviction, release, or completed supervision. It is one year for one misdemeanor, two years for multiple misdemeanors, and five years for an eligible nonviolent felony from the same transaction or series. Violent, sexual, abuse, DUI, traffic, domestic, and other listed offenses are excluded. A verified petition is filed with the Ohio County Circuit Clerk and served on the agencies named by law.

A civil action currently carries a $200 institution fee, subject to confirmation of service, copy, or indigency terms with the clerk. A granted order also has a $100 WVSP processing fee unless a qualifying §61-11-26a path waives it. Covered court records are sealed and agency records expunged, though limited statutory access remains.

Dismissed Ohio County Records Can Remain

A dismissal changes the court outcome, but it does not by itself delete the police report or historic booking entry. Each system receives and updates data on its own path. A portal may show a case disposition before the fingerprint repository receives it, or a booking record may preserve the charge stated at intake after prosecutors amend the filed count. Compare the live court file with the agency source before treating a mismatch as error.

When a submitted disposition is inaccurate, first ask the court or arresting agency to correct its source data, then use WVSP Form 136A for a CIB challenge if needed. When the record is accurate but the person wants it removed from routine public access, the issue is expungement eligibility. A data challenge and an expungement petition solve different problems.

Ohio County Custody and Supervision Records

Probation and parole are not the same record stream. An Ohio County sentencing docket establishes probation, and West Virginia Judiciary probation officers serve the Circuit Court. Ohio County Criminal Records by City

City police departments make their own incident and arrest reports, and local citation channels can differ. The official 2020 incorporated-place ranking puts Wheeling first, Bethlehem second, and West Liberty third. Wheeling has its own police records unit and Municipal Court. Bethlehem routes police calls through county dispatch and has no published records portal. West Liberty has both town police and a separate university campus police agency, so the event location and responding unit matter.

Ohio County Crime Records Need Context

Ohio County covered 105.83 land square miles and had a 2025 Census estimate of 40,496. Nearly one quarter of residents were age 65 or older in the 2020 to 2024 measures, a useful reason to preserve phone and counter access beside web portals. Wheeling remains the county seat and justice hub. Its compact Chapline Street corridor links city, county, federal, and supervision offices, shaped by a history that includes the National Road and service as West Virginia's first capital.

Wheeling Police reported 20,784 calls for service in 2025. Arrests, NIBRS Group A offenses, and Group B offenses each fell 14 percent from the prior year.
